Many of our clients have family members with citizenships and residencies in different countries. We have extensive experiences working with top international lawyers, trust specialists, and CPAs to create a unique estate plan, which satisfies each client’s particular circumstances, priorities, and goals.



What to Consider:



  • US Pre-Immigration Planning 

Non-US persons may decide or need to reside in the US for multiple reasons including, but not limited to, employment relocation, business ventures, retirement and education. When assessing immigration to the US, whether on a temporary or permanent basis, foreign persons must consider many aspects in addition to the cultural differences they may face. Immigration status, applicable taxes, securities regulations and the legal framework to which they may be subject during (and possibly after) their stay are all important issues that should not be overlooked.



  • Generation Skipping Transfer Tax 

The generation-skipping transfer (GST) tax is an additional layer of tax imposed on transfers to grandchildren or anyone else treated as being two or more generations younger than the transferor. The maximum federal GST tax rate on transfers in excess of the GST exemption is 40%. As with the gift and estate taxes certain states also impose an estate tax over and above the federal GST tax.



  • Insurance planning

Life Insurance is an important vehicle for our clients to transfer wealth to next generations.  It is also a way to help cover the losses that arise from the occurrence of contingencies and events that could not be avoided. It can provide funds to the family to help pay for short and medium term needs and to cover estate or inheritance taxes. Understanding the differences between pre- and post-tax insurance is imperative.



  • Estate Planning Process 

Given their importance, the necessities of estate planning (Wills and Trusts) are usually addressed first. Individuals expecting to have an estate in excess of the federal estate tax exemption amount often consider making gifts because a lifetime gift removes the asset and any of its future appreciation from the total estate of the donor. This potentially minimizes the total estate and gift tax. Leveraged gifts (like a Grantor Retained Annuity Trust) can be used to attempt to transfer assets in excess of the exclusions from, and credits against, the transfer tax (or where the donor wants to preserve the exclusions and/or credits for later use). Individuals not interested in keeping control can make outright gifts. Individuals not interested in keeping control themselves but interested in keeping control away from the donee can use a trust. Individuals interested in keeping some control of the assets themselves may use a family limited partnership.
